By accessing the Services, submitting information, or completing any form or assessment, you acknowledge that you have read and agree to these Terms.

1. Who We Are

ZenCrest Homes is a real estate brokerage licensed in California (DRE# 02227560), Washington (DOL# 24030374), and Texas (TREC# 852981-B), serving Newport Beach CA, The Woodlands TX, and Bellevue WA.

2. Fair Housing

The Services, including all text, graphics, logos, the ZenCrest Homes name and monogram, and the Agent Leverage Assessment methodology and scoring system, are owned by or licensed to ZenCrest and may not be copied, reproduced, modified, distributed, republished, or commercially exploited without prior written permission.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose.

7. Limitation of Liability

To the fullest extent permitted by law, ZenCrest will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Services.

8. Governing Law

These Terms shall be governed by applicable California law, except where federal or other applicable law requires otherwise.

9. Changes to These Terms

We may update these Terms from time to time. When changes are made, the updated Terms will be posted with a revised Effective Date. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of those changes, to the extent permitted by law.

10. Purpose of the Agent Leverage Assessment

The Agent Leverage Assessment is an AI-generated educational and informational resource designed to help licensed real estate agents evaluate aspects of their current brokerage environment, including lead generation, technology, infrastructure, compensation, and career alignment. The Assessment uses information provided by you together with a scoring methodology and other information available to us. The Assessment is intended to provide general educational guidance and does not constitute a guarantee, prediction, certification, or representation regarding your business outcomes or career prospects.

11. No Business Valuation or Guarantee

The Agent Leverage Assessment is not a business valuation, financial analysis, career counseling service, legal opinion, or other professional opinion, unless expressly identified as such in a separate written service.

An Assessment score or report does not establish:

• the value or health of your current or future business;
• the likelihood of increased production at ZenCrest or any other brokerage;
• the compensation, splits, fees, or economics you would actually receive at ZenCrest; or
• whether you will qualify for or be offered affiliation with ZenCrest.

Any decision to change brokerages should be based on a full, independent review of your business, your current agreements, and the specific terms offered by any prospective brokerage.

12. AI-Generated Content

The Assessment and portions of the report may be generated or assisted by artificial intelligence ("AI"). AI-generated information may contain errors, omissions, or inaccuracies. ZenCrest does not represent that every AI-generated statement is complete or error-free. AI-generated results should be treated as educational guidance and should be independently evaluated before being relied upon for any significant career or business decision.

13. No Offer of Employment or Affiliation

Completing the Agent Leverage Assessment, submitting this form, receiving a report, communicating through the Site, or requesting additional information does not create an employment relationship, independent contractor relationship, brokerage affiliation, or offer of affiliation between you and ZenCrest. Any affiliation with ZenCrest must be established through a separate written independent contractor or affiliation agreement, subject to ZenCrest's application and qualification process. Nothing in the Assessment, report, website, or communications should be interpreted as an offer of affiliation unless and until such an agreement is executed.

14. Existing Brokerage Agreements

If you are currently affiliated with another brokerage under an active independent contractor agreement or similar representation agreement, the Agent Leverage Assessment and any report provided through this Site are for informational and educational purposes only. The Assessment is not intended to solicit or induce you to terminate, breach, or interfere with an existing brokerage agreement. You should review your existing agreement and consult your current broker or a qualified professional regarding your contractual obligations before taking any action.

15. Assessment Scores and Recommendations

Assessment scores and recommendations are generated using the methodology established by ZenCrest and information supplied by the user. Scores are not objectively determined measures of your business's value or potential and should not be interpreted as such. Different information, changing market conditions, or professional review may produce different conclusions.

16. No Guarantee of Outcomes

ZenCrest makes no guarantee regarding: whether you will be accepted for affiliation with ZenCrest; the economics, splits, or compensation you would receive if affiliated; the volume or quality of leads or opportunities you would receive; your production or income if affiliated with ZenCrest; or any other business outcome. Real estate business outcomes depend on numerous factors outside our control, including your own effort and market conditions.

17. Real Estate Recruiting Disclosures

The Assessment may constitute recruiting advertising or solicitation directed at licensed real estate professionals. Applicable brokerage, license, and other disclosures will be provided as required by California law and applicable professional rules. The responsible brokerage and license information associated with the Services should be reviewed before relying upon any representation concerning ZenCrest or its licensed professionals.

18. Prohibited Use of the Assessment

You agree not to: submit knowingly false or misleading information, including regarding your licensing or production; attempt to interfere with the operation of the Assessment; copy or reproduce the Assessment methodology without authorization; or use information obtained through the Assessment in a manner that violates applicable law.

19. Communications

If you provide contact information, we may use that information to respond to your inquiry, provide a requested Assessment, communicate regarding your report, or provide information about ZenCrest and, where applicable, potential affiliation opportunities, subject to applicable consent requirements and law. Where required, marketing communications and text messages will be subject to separate applicable consent and opt-out requirements. You may opt out of marketing communications using the instructions provided in those communications.

20. Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy and California Notice at Collection. Those documents form an important part of your use of the Services.
